BALLSTON SPA — West Mountain, represented by Jim Kelly, was not responsible for
injuries sustained by a Saratoga Springs woman in 2008, a jury decided Thursday.
On Jan 1, 2008, Sara Finn, of Saratoga Springs, fell while attempting to ski
off a lift and broke her pelvis in four places. Finn sued the mountain’s
owners, contending that her fall was caused because snow and ice had built up
on her skis as she went past snowmaking guns near the lift.
A jury found that West Mountain was not negligent in the case.
The jury agreed with the mountain’s representatives’ contentions that they
weren’t responsible because Finn assumed the risk of injury per state skiing
law and because the snow could have been blown in any direction.
